No, what will get your kv banned is modding online, player reports, and running homebrew on your console while connected to XBL.

Obviously is was just a matter of coincidence that you got banned maybe you should expect that next time your modding online

Of course downloading ghosts TU gets you banned. Once the title update downloads, you automatically connect to ghosts servers. The servers detect your on a Jtag/rgh so insta ban you. The servers probably relay the information to Microsoft, who issue a console ban.

You don't connect to the server until you go into the extinction, or multiplayer part of the game. I highly doubt they keep logs on all the consoles that download Title Updates, just to relay it to microsoft.
