yes you can play online, it is just the xbox, because what if you have a brother who plays on the same ip as you !? Then it would mean he would get banned for nothing . So yeah the answer is YES

when u get a new console use a different profile or it will flag your Ip

No your fine, you will be able to connect, I suggest switching your IP, but you should be just fine, do not get in trouble or caught anymore, keep it down low.

i Wouldnt risk it, my friend got a new console cause he was console banned, when he connect to live on his new xbox on the same account, about 2 weeks later he was console banned again lol. ended up just having to make a new acct, got the xbox one so yeah.
