Still a pretty crappy excuse though, for him to be in constant danger in a adult prison instead of a safer alternative.

He could be hurt if he had any contact with older inmates plus he will learn stuff that they probably not want him knowing that could hurt other people.

sounds like something an adult would do.

a average 10 year old would probably through his xbox controller at an other person if they got mad.

I'm pretty sure he deserves to stay in jail.

I'm pretty sure minors can't go to a penitentiary where adults usually go.
Where I'm from, if a kid is to commit a criminal offence, he/she is put in a juvenile detention.
