I jailbroke my unactivated idevice and ive been wondering will they still activate it if its jailbroke ?

Yes. Jailbreaking is not illegal anymore and really the only thing that it affects anymore is if you have a device that has a warranty. The modification of the device can sometimes ruin it if the end user has no clue what they are doing, resulting in companies having jailbreaking your device void the warranty.
