ok..so I tried the review but It wont do anything becuase I dont have an active Xbox gold subscription.
Why would I if the name is banned? I let it expire since I couldnt use it. Makes no sense.

Unfortunately once you are permanently banned, you will stay banned, in the rare occurrence you are able to successfully appeal your ban, then the ban will be removed.

You can appeal you're ban on Xbox.com and you can setup a review from microsoft

If you go into the email your account is under you can see the reason they banned you.
