On Thursday night, Alabama executed Ronald Bert Smith Jr., who was convicted of murdering a convenience store clerk in 1994. Shortly after the executioner administered midazolamthe first chemical in a three-drug cocktailSmith struggled for breath, heaved, coughed, clenched his fist, raised his head, and opened his left eye. His lips also moved, but he could not speak, and he appeared to react to both consciousness tests that a prison guard performed. However, prison officials went ahead with the execution anyway, administering chemicals to paralyze Smith and stop his heart.

The Supreme Court permitted the use of midazolam in a 54 decision in 2015, though the drug appears to have caused multiple botched executions by failing to render an inmate truly unconscious. In dissent, Justice Sonia Sotomayor noted that the three-drug cocktail administered to Smith may be the chemical equivalent of being burned alive. Hours before his execution, Smith had asked the Supreme Court to halt his execution given the known problems with midazolam. The court refused. It seems quite likely that Smith was at least partly conscious when he was given the second and third chemicals of the cocktail. If so, he experienced a slow and brutally agonizing death but could not express his pain because the second chemical had paralyzed him.

If Smiths family decides to seek restitution, it is likely out of luck. After Oklahoma tortured Clayton Lockett to death for more than 40 horrific minutes, his family sued, alleging a violation of the Eighth Amendments ban on cruel and unusual punishments. In November, a federal appeals court threw out the familys lawsuit, calling the slow torture of Lockett an innocent misadventure.

What is painfully ironic here is that these three drug cocktails were introduced to be more humane and make the people orchestrating the execution feel better about it. This is more barbaric than the guillotine. This is more barbaric than the firing squad.
If the US insists on having capital punishment as a legal sentence then they need to work out these problems, or just start shooting their death row inmates instead.

I believe that he deserved to be executed, but to be executed in this way is just purely unethical and unconstitutional. I'd like to see something more come of this, and force a change to be made. Unfortunately I don't think that will happen because of the US's terrible media coverage. Nonetheless, I hope to see a change in the near future. Thanks for informing me about this.

Just another reason why I am done with the death penalty. It is garbage. If a person must die, I feel it is a scum move to make him/her suffer. Being basically silent (not doing anything about it) on the "accidents" is unacceptable. These people don't need to die anyway. People just want them to. It's gross.

The only fact that a person should need to consider in order to be against the death penalty is that innocent people are killed as a result of its legality.
1 inmate in every 25 sentenced to death is innocent.

However, people who argue against this point propose that the exoneration rate among death row inmates is about 2% while the exoneration rate among inmates sentenced to life is .188%.
Their argument is that it's better to be innocent and sentenced to death because you are more likely to be exonerated than someone who is innocent and sentenced to life. Either way you die in prison.

The solution to this, I think, is quite simple.
The death penalty costs, on average, $1.26 million per case. That cost includes court fees, medical exams, the cost of the equipment, etc.
Non-death penalty cases cost around $700,000.

If the death penalty were abolished then the $90,000 used in maintaining each death row prisoner per year could be put towards better prison institutions and better legal representation to increase the numbers of innocent inmate exoneration's across the board.

1.26M is some bullshit excuse. I think they should just bring back firing squads. One bullet, less than a $1.00 for the government to waste on such worthless trash.

How do you know if the store clerk suffered before his death? You don't. He could've been shot in the **** kidney bleeding out. Slow horrible death, which is what this inmate got in return.

Can't argue against an honest death penalty advocate. It would have to involve changing your entire personality, although you did gloss over the fact that innocent people die.
