You said you dont have a kv on? Delete the cpukey txt and cpukey bin. Reboot and text connection. If it says banned but a kv and cpukey on reboot. Unplug the powerbrick for 10 to 15 sec and turn on

You find these on your hdd. It will be labeled cpukey.text and cpukey.bin

When I bought the RGH these files weren't included, do I have to manually add them myself?

If he doesn't have a KV on and has never put one on, he won't have these.
OP try disconnecting your router for about 10 minutes and connecting it back then trying again on your console. I've had this issue before and that's usually fixed it for me.

I did a quick unplug and plugged it back in and it still didn't work, do I need to have the cpukey.bin to be able to connect to Xbox live? Or do I have to restart my router for 10 mins

You don't need the cpukey.bin file as that goes with your KVs. A quick unplug won't work, do it for about 10 minutes.

I just suggested 10 minutes because that's what's worked for me in the past when i've had this issue.
