Ive had my Xbox one since release and hasnt been console banned from modding on my RGH.

There is always the possibility but depends when you do with your RGH. I've heard impersonating Microsoft staff will most likely lead to retail bans. Could depend on your stealth server also. I'm using Ninja and I haven't been using a VPN lately and I'm fine. But if you're worried use a VPN.

Just be smart with it, Don't have both consoles on at the same time, don't recover a bunch of modded account's to your xb1 and reset your router before switching consoles, and you should be fine.
If you really don't want to risk it you could just use a vpn when you're on your RGH.

I have my Xbox One un-banned and was modding for 7 days straight when I first got my RGH.

I do try to avoid having them turned on at the same time, even though I have a VPN. But I'd still avoid having them both on at the same time.
