Should I pursue this further or just drop it as is.
So, last night I bought a brand new 52'' Husky Toolbox. It was on sale for $498 rather than the original price of $598.
I had to drive 1.5 hours to the store that had ONE in stock. Upon arrival I was informed that they have ZERO in stock and the ONE listed on the site is the Display model... what? The employee then went on to say he can't sell it to me. Spent about 10-15 minutes on his computer trying to look it up and then called his manager. The manager said to sell me the display model if I wanted it. (SCORE! I GET MY TOOLBOX TONIGHT!) So, we then went around the store and found it in a random aisle near the bathroom..? He was pretty concerned that someone else has already bought it and had it assembled for him. So then we waited around for another 10 minutes to be told: "no its not sold otherwise there would be a sticker stating it was sold". Now, the dude seemed upset that he was in the wrong.. not only was I going to be able to buy the display model but I'm also getting one he thought was for someone else.. He even said to the manager " You will hear from the owner of this chest if there is one " Which I completely understand.. he was doing nothing wrong but trying to not screw someone else over. As we were walking to the register he asks if I have something big enough to load it into.. like why would I even try to buy one if I wasn't prepared.. grumpy pants.
Anyways, we brought it up to the front and I pay for it. I bring my truck around and drop the tailgate. We, then stand there for a few minutes and I then asked if they have a screwdriver so I can take the top chest of the bottom chest. He looks at me then turns away and then says we will just get more guys to help lift it. So, 4-6 dudes show up (It happened fast I wasn't counting the guys lol)
They all lift it up into my truck and literally within a second of it sitting still in the truck they say thanks have a good night and leave. So, I'm out here in the cold, never loaded anything like this before.. the chest stands at 5' 6'' and is I think 22'' deep, so this thing is unstable as is. I locked all 4 locks on the wheels and I applied straps.
So, now this is where it becomes my fault. I should have gone back into the home depot and bought a screwdriver.. even tho it would have been such a stupid purchase because why couldn't they have just borrowed me one to make this lighter to carry and safer for transport? I also only had two straps at the time and me being so excited I wasn't thinking right anymore. I put both straps on one side of the tool chest on each side of the tail bed ( Like a V shape coming off the tool chest). I started driving to a local Walmart which was .8 miles from the home depot to get a screwdriver to take this thing apart and I had other things to grab while I was in town. I drove about .4 miles and the tool chest fell out of my truck. I was going about 15 MPH and the wind tipped it over and the top snapped right off when it hit the side of my tail bed. The top is now destroyed. The bottom is good still, the lock makes an annoying rattle sound if you bump into the chest but that's about it. Besides the holes that had the rivets holding the top down.. those are torn wide open now.
So, all my fault? Or, should the guy have just borrowed me a screwdriver? Maybe they should have layed it on its back... we all obviously didn't plan on this happening. Should I pursue this or just take the L and fix it up so it closes properly.

In the end its 110% your fault. The last thing they did was put it in the truck and its your job to strap it down so that way it doesn't tip over or fall off the truck. If you went after the store they would probably just laugh at you tbh.

But I did go and mess with it and they gave me 100$ back... for my own mistake. A get well soon gift. And, I have already hit it with a hammer a few times so now everything works like it is brand new but its just scuffed up.. but I dont even care anymore. I paid $433 after taxes for a tool chest that cost $598 ($633ish after taxes).
Not to sure why they gave me $100 back but Im taking it and running..

I don't know what they'd do on a high ticket item like this, but Husky has been good to me about returns. Just this last trip to San Diego I had a BRAND NEW literally just bought for this job 18" tool bag and TSA destroyed it. Zippers ripped, holes through the side and one wheel entirely sheered off. Husky just said sorry for the trouble and shipped me a new one. I didn't even ask, I had E-mailed them to see if they sold replacement wheels for these bags so I could just use it as a house tool bag but they just sent me a whole new one no questions asked.
As you know it's your fault for not having it properly secure and not to expect anything, but Husky is a really good brand and might work with you.
