Just like most updates from MS, it will cross refferance your system as of now, compared to what it was when it left their factory. If you done something wrong while flashing new firmware to your drive, you will get banned. no question about it. The easiest way to be sure your not going to get caught, take out the modded drive. no modded firmware, no ban. Easy as that. I updated this morning myself. I am using a BenQ drive with iextreme LT 1.2, The drive has a power switch that I installed personally for this purpose. Just turned off my dvd drive, updated, then flipped my drive switch back to on, and viola, xbox live again

Im new here, in fact this is my first post, i have 2 flashed boxes, i went home on my lunch from work and tested my older box, it updated fine, signed in to live fine and i put in the iso disc for black ops and that read fine. I would say they will probably use the dash update to gather info on who has modded firmware then do a banwave shortly after black ops comes out, if i remember right from last year i got banned about a week or 2 after modern warfare 2 came out
