common sense? common sense would say that a game that a store sold you you should be able to play if it is a legit copy and you bought it with your own money. it should be the stores fault for breaking release date.

Yes it is if you purchased the copy legally from a store. The only thing is they can reset your stats and stuff like that like they did with players who got reach early.

It is BOTH persons fault, one for giving it away illegally, one for talking a dumb store manager into it and paying for it illegally.

Well, actually no, you shouldn't really be banned, it's the retailer's fault for selling it early. What will probably happen is the day of public release, the leaderboards will be reset, so everyone starts equal.
