No, you may do whatever you like, as long as you don't interfere with Gov't laws. Compare it to a car. If you buy a car from a "dealer" and lower the cruise control limit from 25 to 10, the Gov't is not gonna be all over your ass.

so basically, jtags are not illegal at all, going online not illegal anybody who says it is, is getting illegal mixed up with microsofts terms of use, microsoft bans people for violating the terms or use which is not illegal, its like swearing on certain websites and forums they ban u but iut isnt illegal, the only thing really illegal about jtags is being able to play backed up games so its not breaking the law in anyway if u dont play backed up games.

The only illegal part of a JTAG is being able to put games on HDD that you do not own. If you own the game then it is legal unless you sell it. Now the DMCA said you can modify any electronic device ect... But the reason you get banned is because of the Terms of Use

They are completely legal to have, what is illegal, and punishable by law, is the use of any sort of modified dashboard, online or offline. essentially making Jtags illegal. This is punishable with up to a $250,000 fine and i believe a year in jail.
Its the same as pirating movies... the chances youll get in trouble are slim.
the actual physical modification that is considered (when finished) a "Jtag" is considered "Jailbreaking" and is not punishable, this is your property Microsoft can not fors laws upon a product that is not theirs.
