I called Activision, and gave them a bunch of my information. They are sending it to someone that looks at each ban individually and determines why they where banned, and will unban them if it's not a legitimate reason. They will send the results to the eMail you provide them; and if they determine to unban you they'll do it on the spot. I can only hope they aren't sending it to someone in Treyarch, cuz they are all dicks.

If you get banned, here's a step by step process.

1st - 4 (all other games)
2nd - (say CALL OF DUTY)
3rd - (say YES) to "Call of Duty Black Ops"
4th - (say XBOX 360)
5th - 2 (conecting to mulitiplayer game)
6th - (say CUSTOMER SERVICE) keep saying customer service until you get transfered
7th - (wait on hold - navigate any further to Black Ops)
8th - (wait a little longer)
9th - Explain that you have been banned from Xbox Black Ops Server. You don't know why (or you can say you were boosting, and/or organized gaming). You can bitch and moan all you want at them, but in the end they just need some information. It's okay to show your frustration, but ranting and bitching at them won't do anything. They can't do anything personally for you. If you want to you can ask further questions, and explain to them how lame it is to be banned for not breaking an Terms of Service, or Code of Conduct.
10th - Have the information below ready:

1. Select Multiplayer
2. Select Options
3. Press the System Info button labeled at the bottom of the screen (Back for 360)
The following information will need to be collected from this menu:
