What makes this NOT bannable for the infected xbox360, compared too the jtag xbox themselve?

I have 100 answere that it is untraceable. Just need a explanation how?

Is it because the jtag saves their files on live servers, but the uav only are on my xbox? Is that why it goes away when turn it off?
