The Digital Multimedia Act of 2000 states that you cannot ban system from a game. You can only ban the account that has been hacked or exploited. Stopping someone from playing a game that they payed for and deserve to play is not legal..

"Video games accessible on personal computers and protected by technological protection measures that control access to lawfully obtained works, when circumvention is accomplished solely for the purpose of good faith testing for, investigating, or correcting security flaws or vulnerabilities, if:
The information derived from the security testing is used primarily to promote the security of the owner or operator of a computer, computer system, or computer network; and
The information derived from the security testing is used or maintained in a manner that does not facilitate copyright infringement or a violation of applicable law."

Digital Millennium Copyright Act of 2000

This is being taken into new hands and the issue will be addressed quickly. I will agree that hacking should not be tolerated. But you cannot stop us from playing this game if it has been bought.

If they had of concentrated on fully finishing the game instead of allowing Activision to rush them, they would have been able to make the game unable to be hacked!

I believe they should ban the account. And if the modding or hacking continues on the same console maybe and maybe then should you get hit with a console ban.I believe it greatly reduces value for that console.

Information comes from other site.I take no credit for it.

i think you will find when you accept the "terms and conditions" there will be in the small print that they have the right to cancel /ban your account if you break there set rules... i.e modding etc

I think if they wouldn't be allowed to do it, they wouldn't.
They wouldn't run the risk of getting sued.

I think you don't get the point. You own the console, you are free to do what you like with it. However, you don't own Microsoft's firmware that is used in the consoles. Therefore, altering it is breaking your terms and conditions that you signed with Microsoft.

Microsoft have the right to ban your console without warning. Always read the terms and conditions.

They are not banning you from the game only the online feature. The terms of use say something about banning because on modding.

When you signed up for your Xbox LIVE subscription you would have accepted their ToS.

Detailed within this ToS is this:

Xbox LIVE ToS wrote 12. Service Operation and Equipment.

The Service may only be accessed with an Authorized Device or by logging into your account via Xbox.com. You agree that you are using only authorized software and hardware to access the Service, that your software and hardware have not been modified in any unauthorized way (e.g., through unauthorized repairs, unauthorized upgrades, or unauthorized downloads), and that we have the right to send data, applications or other content to any software or hardware that you are using to access the Service for the express purpose of detecting an unauthorized modification. Any attempt to disassemble, decompile, create derivative works of, reverse engineer, modify, further sublicense, distribute, or use for other purposes the Service, any game, application, or other content available or accessible through the Service, or any hardware or software associated with the Service or with an original Xbox or Xbox 360 console is strictly prohibited and may result in cancellation of your account and/or your ability to access the Service, and the pursuit of other legal remedies by Microsoft. Microsoft may take any legal action it deems appropriate against users who violate Microsoft's systems or network security, this contract or any additional terms incorporated or referenced in this contract, and such users may also incur criminal or civil liability.

Microsoft reserves complete and sole discretion with respect to the operation of the Service. Microsoft may, among other things: (a) restrict or limit access to the Service; (b) retrieve information from the Authorized Device and any connected peripheral device used to log onto the Service as necessary to operate and protect the security of the Service, and to enforce this contract; and (c) upgrade, modify, withdraw, suspend, or discontinue any functionality or feature of the Service, any game or other content available or accessible through the Service, or any hardware or software associated with the Service or with an Authorized Device, from time to time without notice, expressly including by the automatic download of related software directly to your Authorized Device, including software that prevents you from accessing the Service, playing pirated games, or using unauthorized hardware peripheral devices.

Therefore, Microsoft are within their right to ban any console which has gone against their ToS.

Also, I'm guessing this rage from you is coming up due to a recent console ban that you received?

Yeh there is.But crippling the console especially on your first offense and right after purcahasing a map pack and never ever being able to use it is not right at all.I see something happenning in the future.

Im guessing we the people that got consoled ban from there servers have a pending ban from MS as well in the near future.

Give us 1 of the 2 GT bann, fine we can make a new one.
Console bann we can buy a new one but still play with gt.

Not raging just in case. Its great they doing what they can to keep the game legit but they going a lil to far.And this is just the beggining!Others will take do the same learning from Treyarch.[/list]
