You can't get banned for doing this because it is a lisence transfer.

Why on earth would you get banned for doing this. Microsoft allows you to do this for a reason and that reason is not so they can ban you.

Wouldn't it work if you just have a friend copy it and move one on a USB and keep one on his xbox then plug the USB into your xbox move the dlc to your HDD then play?

I think you would only be able to join session in progress with people who have it if you do that.
