I just modded my controller with a momentary pushbutton and was wondering if MS can some how find out I have it modded.

no only if people report you for cheating then they will check into it. Your best bet is to try the jitter mod. Never tried it before but here its good!

Modded controllers aren't against the ToC. The controller I have is actually licensed by Microsoft so I'm set there if they do decide to ban for it lol

Microsoft cant ban you for modded controllers as they endorse like 5 of them lol,
Endorsement means if it breaks you can send it to them and they will fix
