Well I was thinking...Couldn't we make a replica of XeX menu or something similar to that with XNA game studio that allows you to transfer/replace files on your hard-drive/usb? And then unpack the game to our xbox with the XNA?
I don't know much about this so don't hate me if it sounds stupid or if there is no way to remake it...

Firstly, if you're talking about a retail, even if you make the programme it wouldn't work as it's unsigned coding, which the xbox checks for and wouldn't run it.
If you're talking about a jtag, then xex menu lets you transfer/replace the files on it anyway?

For it to get on the marketplace surely it will have to be signed by MS, I highly doubt they will put a game on the marketplace which is promoting piracy and modding

With XNA game studio you can create your own Xbox games and apps(on a retail)...(The program to make indie games...)I was wondering if it would be possible to remake XeX menu using it or make a program similar to it.

Wouldnt work , you are trying to get unsigned code which a retails would reject and wouldnt work.
The only way it would work is on a jtag but we have xex menu or xex loader. So there is no point.

I'm going to be completely honest, and I'm not trying to be a dick -- but a lot of you guys are right on some things, but taking repeated items and just applying it to something you don't know about.
The reason why this wouldn't work is quite simply...
XNA games don't have full access to the Xbox 360. They can only access their directory on the hard drive, they can't "launch" other apps, and they can't access a raw thumb drive. XNA games are very limited to what they can do in comparison to what a full retail/arcade game (really anything coded up with the official 360 SDK, not including the XNA extensions) can do.
