no they only disable xbl on the console that got banned
so if you were to recover it you would just continue play as normal and if they ban you you can phone them up and stuff

A console ban directly relates to the console itself, not the gamertag. You should be fine if you dont modify your new xbox. I dont think a console ban would directly relate to anything you mentioned, I have both of those as well and I have not been console banned (yet)
If that is all you have done you may want to get your ban re-checked, to do so go to the xbox forums and there is a guy (dont know his name sorry) who you send your info too and he double checks console bans.

Hm, console bans are given when they have "overwhelming evidence of you break the COC or TOS, ToU." Stuff like that. But regarding your new console, I'm pretty sure if you recover the account, it will not get banned on the console, or the console wont be banned.

Didn't TTG_JoE_oH get a new console after he got banned and continue playing on his account? Go ahead and get a new console, with the account you use. But I'm sure Xbox will be watching you, so stay out of trouble!
