You can not get that gamertag back, the only possible way would be if there was a reset which I highly doubt would be any time soon and the other way would be if you somehow got it unbanned but the ch ...

Using a RGH you can spoof the gamertag. Ive did it myself on my old banned account but you cant unban your gamertag sadly
