Call up Microsoft and just explain to them they told you they would make the account better or some shit, and that they are not giving it back. Answer your secret question and last 4 digits on the credit card, and you could probably get the account locked until you get it back.

just call Microsoft they will ask for your email and recovery question they will take 1-4 weeks to get your account back but they do get it for you and they can even ban him
