Below is a quote made by DJArcas regarding the rumor about being banned for updating FortressCraft and having it become duplicated, then receiving a ban.

I see your point regarding the updates and multiple copies (and having multiple copies of the game on your Xbox causes ME a big headache!) and I've repeatedly had to tell people to remove multiple copies; however, downloading an 'update' for a game doesn't count as 'downloading the full version for free'

I just want to quosh any rumours that 'Downloading Fortresscraft gets you banned', as that is simply not true.

I've been involved with the enforcement team before, and I'll just quote VoteDC :

"Bans are not automatic. All evidence is reviewed by a member of the Enforcement Team, so they would see that you'd bought the game before the duplicate and so it is highly unlikely they would then click the BAN button.

People will try anything to try and get of out their ban for stealing stuff. "

If you have REALLY been banned for nothing at all, then Microsoft will deal with you on a case-by-case basis; if you post in the appropriate forum, they will tell you exactly why you are banned.
