Jailbreaking is what the process of hacking an iPhone to free it from Apples limitations
is called. Jailbreak can be used to make an iPhone usable on any network (official,
approved carriersAT&T and Verizon in the U.S.) and to allow users to customize
iPhones without restrictions. There are lots of benefits to having a jailbroken iPhone, but
the question is, is jailbreaking illegal?
In July of 2010, the United States government ruled that jailbreaking is legal and and does not
violate copyright, as Apple had previously claimed.
However, according to Apples user agreement, jailbreaking voids the devices warranty.
So if youre taking your iPhone or iTouch in for service and its been jailbroken, itd be
in your best interest to do a clean restore before the Apple people inspect it.

No its not illegal. Jailbreaking is not illegal. You payed what, 400, 500 dollars for this, and in return, Apple gives you a beautiful piece of technology, you are free to do what you want with it. It may freeze your iPod, but restoring it always works. It is in conflict with Apple's T.O.S., but they can't do anything but Void your warranty.

It's perfectly legal. But if you use Installous to get free apps that cost money on the App Store, it then becomes illegal.
