You can't buy jtags in stores because microsoft doesn't approve of them.
Just because microsoft doesn't approve of them does not mean they can sue people for messing with the stuff they sold.
For example, if you sell a brick, and somebody chisels it into their own form, and sells that.. there's nothing illegal about that, is there? That's exactly what a jtag is.
