Yea but you will have to recover your account on your new Xbox and yours saves will show up as corrupt, the way I avoided loosing my saves without having to buy a transfer cable and un-corrupt them is when I recovered my account I saved it on my MU and kept the corrupt one on my HDD and even though all my saves say "Corrupt Profile" they all load and work perfectly fine.

No, I got console banned and my Xbox was brand new, never modded or anything.
