so my drive was hotswapped, and it gave out on me, so it wont play games anymore, i want to get a new drive to replace it, but its a retail console, and i dont want to get banned, what can i do to replace the drive without getting banned, also i dont want to ship it off.

Just flash it. As long as you arent playing burned game they will never know. If you don't want to flash it, send it to Carlooch He flashes them for a reasonable price.
Again, as long as you dont go playing burned games like its your job, you should have no problem.
