Here's a great tip that I have found to be effective. Buy a new console, make a new account, and don't violate the TOS.

The only way you can unban a console right now is if it is RGH'ed/Jtag'ed/XDK or unless you convince XBLPET to unban it, or your a member of XBLPET. You also agreed to the Terms of Use, and you deserve the ban.
