the answer is no i have hotswapped my xbox many times and i host a ton of waw mod menus and you can not be banned UNLESS you do not stealth patch your iso...but as long as you stealth patch your iso your golden!

no you cannot get banned in any way for iso modding stealth or not , it is burnt to your xbox not to your profile , so microsoft cannot see that you are modding

Yes you can get banned, though its not to likely. I've gotten perma banned on one of my accounts back in '09 for ISO modding WaW. The chances that you will get console banned at this point are pretty slim but there is always a chance of account perma ban if you piss people off online and they report you. You have to stealth patch it in ABGX360 before you burn the disc.
