Does your account have any credit card information? If so call microsoft about your situation and they may be able to help, but there is a very low chance anyone here can get your account back.

Call Xbox support, tell them someone took your account and changed password, and try to be serious. If they don't belive you, get your parents on the phone and let them handle it. Xbox don't belive in squeekers. So atleast ask ur brother to help ya or like some friend with a dark voice.

You should always have secure security questions, a mobile phone number hooked to your account and an alternate email or 2.
Personally I have 3 alternative emails, never hurts to be safe with something as sensitive as an xbox live account which can contain, as mine does, credit card details.
As for getting your account back, contact microsoft and explain your situation, as it is your account you will be able to confirm that and they will(eventually)get you your account back.

did he hack you or did you give him your account info? because if you did and he claims you said you could use it you wont get it back unless there is a card on there and if there is you will need to be able to give them the info also call quick before he spends money!! and it could take 2 to 4 days before you get the account back

Ones account does not simply become "hacked."
you obviously gave the guy some sort of information that led to him taking your account. You should take full responsibility.
My best bet would be for you to call up xbox support and try to reason with them about getting your account info changed.
