So here is the deal....
Bottom line....I told the guy I was keeping the used microphone and he sent new one anyway....would I get in trouble if I just kept both of them? Like by paypal or ebay?

if he sent you a return box you MUST return it because he could contact eBay and Paypal and you will have to pay for the mic and the shipping even if it was broken. If he doesn't send a return box and doesn't get back to about the used mic then you can keep it

you paid for a mic it was broken he is sending you another one at no charge. If you kept the other mic it would be like he is giving one to you for free and he lost money. He could probably fix the mic or even send it back to the manufacturer and have it replaced or fixed

Because. If he wants it back, and tells you he wants it back, or gives you a return box, you must give it back. If you don't, you could get into some trouble.
