It is actually NOT illegal to jailbreak, root, etc. you smart device because you own it. NOTE:It does void your warranty. However depending on what you do with it has the potential to be illegal i.e downloading cracked apps for free. It is not illegal to modify your own hardware or software that you paid for. 2nd NOTE: It has also been known to get you in a ton of trouble with your carrier if you tether your WiFi on a hacked device.

It is illegal to UNLOCK your phone, not jailbreak it. Jailbreaking will still be legal as a result of DMCA
