I don't think they have a ban list, just a flagging system. If there is a known hoster that xbox is aware of, they'll know who is in their game, who has played with him/her and such. So you'll most likely get flagged for suspicious activity and once they have the proof that they need they will take justified action.

i saw this thing before of when you get reported the system put your name on a list and moderators check it by colour if your name is green you get moved out of it and if it is red they look into it further and decide how severe it was and ban you for a certain ammount of time

No, there is no "ban list" but if more than one account on your console is flagged, they will start watching your ip more carefully... Most likely that's what is happening because that is what happened to me. I believe 3 bans on a console gets you console banned, so be careful of that.
