Obviously there's going to be some level of security so Microsoft probably keep some sort of record. But I think the Government have better things to do than listen to people on Xbox.

lol dude the government is corrupt they have the power and "the brains" to do anything. Saying that this is impossible is like saying you can't tap into a cell phone.

Have you read the kinect settings? It asks you if you will allow microsoft to use your conversations/ voice in order to help them make kinect better.

If they can get recordings of your voices, then you have to imagine what else they can do
