I don't know and I really don't care. However, it's your mistake if you do get busted. Maybe you shouldn't smoke weed.

No, there's no way they could prove that it was weed. That is why you see many hip-hop videos with the artists smoking weed because there is no way to prove that it was indeed weed. Now that may constitute a search warrant, but they have no jurisdiction to actually prosecute you for smoking it on camera.
