if its a legit copy of the game you can play online without the worry of being banned (only if you leak gameplay and are stupid enough to show your gamertag in the video lol)

This. You could always copy and add xbox's security on the disc to make a 99% copy of the original disc. I too want to know how they could tell if it's legit or not.
