In the past, people don't get banned if they stealth patch properly or have the game early although there is no %100 gaurentee that this will remain true to this game.
More than likely yo will not get banned but PLAY AT YOUR OWN RISK.
Just tired of seeing the forums flooded with the same question.

But when the game comes out the topic gonna be flooded with all the people from GTA.
