Well actually, you are modifying the DNS which is the xbox not the game so technically speaking they can console ban you if they want. And I'm sure people will be and have been banned from doing it. Sure there's no valid proof of someone actually loading up the game and it saying they have been console banned or banned but I'm sure people have been banned.
