The US Supreme Court has ruled that police may search a home without obtaining a warrant despite the objection of one occupant if that occupant has been removed from the premises.

With its 6 to 3 decision in Fernandez v. California on Tuesday, the Court sided with law enforcements ability to conduct warrantless searches after restricting police powers with its 2006 decision on a similar case.


Justice Ruth Bader Ginsburg joined in the minority by Justices Kagan and Sotomayor, marking a gender divide among the Justices in the case wrote the dissenting opinion, calling the decision a blow to the Fourth Amendment, which prohibits unreasonable searches and seizures.

Instead of adhering to the warrant requirement, Ginsburg wrote, todays decision tells the police they may dodge it, nevermind ample time to secure the approval of a neutral magistrate. Tuesdays ruling, she added, shrinks to petite size our holding in Georgia v. Randolph.

Realistically, a cop that wants to keep his job and a brain bigger than a walnut wouldn't do that.

Indeed, but most police around here have a brain no bigger than a walnut..theres been a case where a police officer tazed and detained a kid for skateboarding. The kid was just talking about how dumb the laws where about skateboarding in the town, and the cop got hostile..It was on video, and was circulating around the school I was going to at the time, and you could clearly see the kid was showing now sign of aggression..the cop just wanted to feel powerful and show his strength. The cop ended up lying about it saying the kid was getting aggressive and getting in the cops face, thats why he used extreme force and detained him..God I wish I could find the video and make it go viral..

Just goes to show, cops will lie there ass off just to get there ways, they always think they are above the law (dont get me wrong, there are really cool cops, who are there to protect you and care about you!).

You make it seem like there is only corrupt police. :/

There are millions of people in law enforcement that do their job and follow their orders properly without incident.

Only the screw ups make mainstream media, not the good ones.

That is very true but, I've only dealt with the police maybe a handful of times and they were all corrupt. Thankfully I had a phone to record every law they broke so I got off clean.

This is ridiculous. Amsterdam has the only police system that work. Police should not be able to search anyone period. Unless a crime has definitely been committed beyond reasonable doubt. Searching for no reason!!?!? That takes away all privacy among us citizens. Unbelievable.

I'm with Parks, I don't think they should be able to search you period. And most cops that I've dealt with have all been corrupt, but I know a few that are great cops.

You do know that most cops that commit a wrong doing are usually acquitted of the charges put against them simply because they are a cop. There are many cases that proves this.
