This is one of those things that you are pushing the legal line.

I would say that this is okay to do as long as you don't resale. That is what the copyright holders care about is sales, so if you profit from their work they are going to sue and collect their money.

The day I go to jail for something like that will be the day I hit the lottery. Do you honestly think anyone would waste their time in charging you, conducting an investigating and taking you to court, all because you recorded a show with your capture card? Not only that, but how would anyone even find out in the first place? It'd be kept private unless you uploaded it online somewhere. They only place those disclaimers to scare off the few gullible people who would actually fall for it.

Inmate: "Hey, what are you in for?"

You: "Oh, I recorded the new episode of SAO II and got 5 years w/ $250,000 fine."

I've noticed this since I got my cap card. I have the roxio hd pro and I've always been able to record netflix and even livestream it! I of course would never do this but if I ever wanted to record a show I might.

I wouldn't recommend doing that as copyright infringement issues could arise.
