if you own a jtag, Nothing.

If you go online with a jtag, Console Banned.

If you download and install games from the internet on your console, You could be taken to court and possible jailed for piracy.

If microsoft wanted to the could come and take you JTAG. If you read the ToS you are pretty much "Borrowing" the console. Modding it goes against the terms. You, according to them don't own the console.

True, but 99.9% of people don't have this happen. The odds are in your favor.

Someone who isn't me is a federal criminal and has been pirating games for a long time. In the eyes of the law, they owe MILLIONS of dollars in fines.

That's if you sign the ToS while playing online. If you do not sign the agreement and do not play online then that argument is null and void. you have purchased the object and it belongs to you. it is your property to do as you wish.
