So I've got my pc about a month ago and when i playminecraft my max fps is around 40 is there a problem or Is the graphics card trash

Believe im correct in saying that Minecraft is more CPU heavy than GPU.
I also have the R9 280, when i had my pentium id get about 50 frames, but on the quad core AMD FX i get like 140 haha [On Minecraft]
So MC depends on your CPU, nothing wrong with your graphics card.

Here's the problem though I have an amd 8320 shouldn't this make my frames close to or equivalent to yours

Is your graphics card drivers up to date? Also list your pc specs.

Amd 8320 Radeon r9 280 8gb of ram (don't know brand don't have access to pc right now) 1000w psu and a GIGABYTE 970A-DS3P AMD 970 ATX motherboard

If that doesn't work then check your temps using HWMonitor (google it and download it)
You may be getting low frames due to your CPU thermal throttling. Thermal throttling is when your CPU (or GPU) downclocks itself to stop overheating as much, resulting in much worse performance.
