When you upload a video, it will tell you in the vidoe manager if the video is breaking any copyright laws, wheather it be the music on the video its self. Minecraft for example isnt copyrighted when uploading it to youtube, so you can upload as much of it as you want.

When i uploaded the bo3 release trailer it had a 3rd party copyright on it. I can upload it but i cant monetize and make money of it.
