I believe the wait is 6 years of inactivity of the account before the gamertag is refreshed. Then you'd be able to use the gamertag.

It's 5 years, however, I don't think banned gamertags are included, I could be wrong on it.

Thanks for the correction and honestly this intrigued me to contact support, will update once I have a for sure answer as I have a perm banned account since 2013 and would like the gamertag back.
