I was at the DMV earlier today swapping a few titles, and this guy was in for his road test, he was driving a Honda Fit, which apparently belonged to his grandmother who was there with him, and he was failed for a single reason, which I feel an exception should have been made.

When he left to take the test, he was in a handicap parking spot, he backed out like a pro, was looking in all the right directions, all very neatly, an they went off, and when they came back some 20 minutes later, they parked back in the same spot, plate has a handicap logo on it which I noticed when they left the second time, and he had the blue card which he used properly, nothing to do at the DMV except stare out the window, so I witnessed everything except while they were gone.

The car he was using was registered to his grandmother I'm assuming, and when the instructor said he had failed, and why, his grandmother was right there with this guy explaining to the lady that she has COPD stage 4, and that she needed him to do that so she doesn't have a breathing fit, she had her walker and her portable oxygen concentrator with her also.

This guy knew it was a handicap spot, he pulled into it with confidence and made sure the placard was up, and it was his full intention to park there, it was definitely not a case of "not paying attention," but this woman refused to listen, failed him anyway, and they both walked out like everything that could have gone wrong that day had gone wrong.

I feel like this woman should have just acted like a decent human being and understood the situation, especially given the fact that they explained that placard was registered to the vehicle itself, and it wasn't expired, and understood that COPD even in the early stages is misery, I've lost people to it before, and my heart went out to this kid.

Thoughts?

I feel like he should of passed his test, there is no reason. The vehicle is registered to have handicapped parking and is still good, she must of been having a bad day. But hopefully next time he won't have such a rude proctor.

As someone who only lost a point for signaling in the DMV parking lot on my test, this sounds pretty ridiculous. If I was him I would be speaking to someone higher up. Thats not fair at all...

The hell? So he failed the test because he parked in the handicap? That's so wrong, especially if it was not expired, he should have passed.

I agree, if only it was put to a general vote between maybe two proctors at once, and not decided by a single person, which always allows biased opinions to rise.

In a way I understand both ways but Even tho the handicap tag is registered to the car, that tag can only be used by her. So if she isn't in the car then it can not be used. It's teaching the boy that if he decides to go to the store without her, he can not park in a handycap spot even tho he has the tag. I know it's a common problem around here. I see young kids parking in the handicap spot all the time. They have the tag but they are perfectly fine from what I see.

I do understand why the boy did it. I would have done it too. I think everybody would.

Do you really think the DMV will change its mind because some random guy stood up? They have rules and guidelines to follow and its not really up to their digression in something like this.

However in saying that, when I did my test and pulled into the service centre (Australian DMV) I double parked behind 3 cars. But the lady did tell me to which I thought was a bit funny. she said "screw these idiots these spots are for test, park behind them and take your time" or something to that affect.
