Morning all,

I need some advice. My partner was involved in an accident this morning where the car behind tried to overtake her as she tried to overtake the bus in front. The car behind then scraped up the side of the car scratching the door and front panel.

I need Advice as to who is liable or would it be shared liability?

Thanks

That's a tough one tbh man!

did your partner start overtaking before the other car?

If so then I'd say it's the other cars fault!

You need to try get the camera footage from the bus

That will hopefully show your partner already started her/he manoeuvre

If that makes sense!

yeah, I believe the insurance will probably split liability 50/50. She had just begun to attempt to overtake the bus in-front when the driver behind tried to overtake my partner overtaking the bus. The side of our car is all scraped and the person who tried to overtake has a floppy front bumper. It was also a narrow road. Hopefully insurance comes up with some result.
