Epic to continue pursuing its lawsuit against 14-year-old cheater
According to the lawsuit filed by Epic Games, the 14-year-old “actively promotes, distributes, and induces others to use cheat software”.
The teenager is one of the Fortnite cheaters Epic Games filed a lawsuit against back in October. The developer filed complaints with a North Carolina federal court citing violation of the game’s terms of service and EULA. The circumvention of technological measures was also cited in the filing.
A letter written to the Eastern District court of North Carolina by the defendant’s mother in November was “interpreted by the judge as a motion to dismiss Epic’s claims,” according to GI.biz.
In the letter, she stated the game’s ToS requires parental consent for minors to play, consent she claimed was not provided. Furthermore, she stated Epic Games would be unable to prove cheating in a free-to-play game could result in the loss of profits.
“It is my belief that due to their lack of ability to curve cheat codes and others from modifying their game, they are using a 14-year-old child as a scapegoat to make an example of him,” she wrote. The letter adds the company also illegally released the name of her underage son.
Epic followed up this week (thanks, TorrentFreak) with a new filing on April 23, arguing many points made by the mother were incorrect; therefore, it is asking her motion for dismissal to be denied, and is seeking a default judgment against the 14 year-old.

It's so obvious that they're just trying to make an example out of him, and considering how successful the FREE game has been so far and how much profit they've made out of it, they're not even trying to be humble about the whole situation. I for one would be grateful if my free game became one of the most profitable games on the planet. These guys clearly aren't.

They have jurisdiction, yes, that doesn't mean you should do something that could potentially ruin their image as a professional company which will actually result in a loss of profits and stocks, which is in fact what they were worried about in the first place.
Most companies now have anti-cheating measures continually tracking players progress and looking for flags, once warranted and under further manual investigation, if proof is there, player is banned which is what happened to this particular player. Nothing else needs to be done, they're merely using him as a scapegoat, and they CHOSE to keep pursuing him because they knew pursuing a 14 year old kid would bring in more publicity for them. It's nothing short of unethical.
I am all for them to Sue this kid! I dont care how old you are! dont hack the game! its simple! its in their ToS! Let this be a huge lesson for the kid. Many people complain about Devs not doing anything about hackers..and now that a Dev is actually doing something..People are losing their minds
Seems beyond me that you can agree with this situation.... If it was you that it was happening to i bet you would have a completely different opinion on it. The kid cheated yes everyone knows that and so does Epic... but seriously how is it in anyway ok for a big major Corp to Sue a 14 year old child. For posting and teaching people how to do it... When this gets done near enough every other day.... (Not just saying with fortnite but there's a hefty amount out there) Honestly all they should have done is remove the content the kid uploaded and ban him from the game for his wrong doing.... To bring it through the justice system like this and potentially gain something from a child is just sickening to hear. There already banking serious money every other week anyway... It also clearly hasn't done any damage to the game financially either or we would have seen that by now.

That's the thing? The only way that they can prevent cheating is to use some one who has broke the terms of service and the Eula...
The kid choose to do so, he knew that their would be a chance he would get caught, however the parent claiming she did not give her son consent in many ways is flawed by giving her son permission to use an online service that was her consent. Chosen not to n monitor him is in her fault alone.
The boy in question obviously will hopefully learn and the only way to learn is by losing or learning from his mistake
