Xbox 360 user sues Microsoft for $500 billion

The latest case of a Xbox 360 gamer suing Microsoft has surfaced and this time the man filing the legal action is asking for a whopping $500 billion (with a b) from the company. The Seattle Post-Intelligencer reports that David Stebbins from Arkansas filed a motion earlier this week in Seattle as he tries to use the terms of his Xbox Live contract against Microsoft. According to the story, Stebbins claims that on May 6 he sent a notice to Microsoft that he was "unilaterally amending the terms of service" of his Xbox Live contract. He also claimed that if Microsoft did not terminate his contract with him within 10 days, it would have to accept the new terms of service.

In effect, Stebbins is trying to do what companies like Microsoft do when they change the terms of a contract with consumers. Most people receive emails with the new terms and blindly accept them without even reading them.

Stebbins claims that after Microsoft didn't terminate the Xbox Live contract he then invited the company to have legal talks to discuss the case which he claims involve the $500 billion in damages. Microsoft didn't respond in which case Stebbins claims he is the automatic winner of that massive amount of money.

The article points out that Stebbins has also filed lawsuits against a number of other businesses with similar terms. Many of those lawsuits have been dismissed by the courts. Yet Stebbins says he is not just sending out frivolous lawsuits for the heck of it, claiming, "My true goal is not to just harass, and it's not just to get rich. My true goal is to level the playing field

Well I'm a licensed contractor and contracts are serious business there are legal binding terms between two or more party's and as far as I know in the state of California a person
Has the right to terminate there agreement if the contract Is changed.In other words if I the contractor write a contract then the home owners signs then I need to change the contract for any reason the person had the right to make me terminate the contract all together or agree to the new terms.

But still Microsoft lawyers are highly paid and his is not so he is not gonna win but kudos to him for trying !

Byakuya_Kuchiki In all honesty tough, i agree with this guy. Microsoft has been **** us over too many times. Their hardware is **** and is PURPOSELY made to break so they can make another buck. It costs 1-2$ for a disk to be made and yet they charge $60 per copy, and they are STILL going to raise the prices. (it use to be $35) AND they raised the price of Xbox Live membership recently. To be honest with you guys, and i dont know if im the only one, but this is seriously **** up and im tired of it.


Are you stupid?? The hardware isn't purposely made for it to break. Its just that some gamers play too much and they overheat. Thats the truth to how they break. We all know it. Anything else that breaks is proably from you smashing it cause you died in Cod. I think your stupidest point was about the discs. Thats not even MS choice. And it may cost 1-2$ to make the discs but think about the developers smart ****. 60$ might be alot but think about PS3. Exact same price.

Yea it is bull-**** that they raised the price of Live but really, you pay for the service. Gas prices are always changing. Food prices are always changing. Prices for services are always changing. Its not a big deal. You pay once a year.


Ummmm actually yeah dip ****, they do make it to break on purpose. Now, i dont know about the new xbox's but the old ones had a 51% failure rate and they said that they new the problem and when you send your broken xbox in to get it fixed, they DONT FIX IT!!!! THEY MAKE IT THE EXACT SAME WAY IT WAS BEFORE AND BREAKS THE EXACT SAME WAY. You're **** retarded. Look this **** up like i did dumb ****.

Well let me introduce some 6th grade math here. As you see the numbers increase on ps3 and wii at secondary hardware failures but xboxs number goes down and its only so high because the original failure rate is 50% oviously more xboxs, majority, more ###. Not only that but most people with a working xbox arent going to waste their time filling out a survey unless they have RROD and are angry like you. BIASED. i win 8===D~~~~
