Microsoft admits to mistaken Xbox Live bans

For years, Microsoft has permanently banned modded Xbox 360 consoles from using Xbox Live. However, a small handful of systems that found their way onto the banned list are having their permissions restored, the company confirmed today.

The Banhammer has a "reverse" setting after all.
In a post on Microsoft's Major Nelson blog, Xbox Live policy and enforcement team head Stephen Toulouse announced that a number of recent bannings are being overturned on further review.

"We're still conducting our review but the cause appears to be a software issue, not an error on the part of the enforcement team's normal actions," Toulouse said. "It's very specific and occurred between August 29 and September 9, affecting a very small percentage of users." Toulouse emphasized repeatedly that banning consoles is something his team takes seriously, and stressed that the number of mistakenly banned systems was a "tiny set" of those axed from the service during that period.

As for those who found themselves on the banned list unjustly, Toulouse said they don't need to take any action to restore their service, as they should already be able to connect to Xbox Live like normal. Additionally, they will automatically have their account credited in the coming days with 1,200 Microsoft points and three months of Xbox Live Gold.

"You have my assurance that we are investigating how this error occurred and have since discontinued use of the software that was used," Toulouse said.

emmanuel804 well doesnt that entitle someone to be able to sue them? i mean they kicked them off of XBL for no reason and now they speak up basically taking hundreds of dollars away from them

First off they can ban anyone they want because you are using their product. So no, you can't sue them for banning you, even if it is for no reason (from my understanding).

And if you read the article you would know they added 1200MSP and 3 months of gold to those who got banned.

I think they reserve the right to ban u cuz u accept the terms and conditions when u sign up
But he didnt act out of terms over the code of conduct. Thus he didnt break any rules and didnt deserve to be banned

No you cant ban anyone for no reason, go to school. if the person did not break any code of conduct the microsoft has o right to ban them because they are paying for the service and they paid for the console.

It would be worth getting accidentally banned for a few days as you get 1200msp and 3 months of live for free.

They aren't banning people intentionally, mistakes do happen and they are working to fix them.

Give Microsoft a break, there's always so dumb person trying to sue them for an equally dumb reason.

OT - I hope I get some msp then. I got console banned over a year ago now and had no flashed firmware or any previous offences.

KiiLER Ive gotten banned right after i paid for a brand new gold account, it happens, someone needs to start a lawsuit

You can't sue Microsoft for banning your console.
