ITC delays Microsoft Xbox 360 US import ban decision

A decision on whether or not Microsoft's Xbox 360 game console should be banned from being imported into the US has been delayed. Reuters reports that the full panel of the US International Trade Commission has sent the case back to its judge for reconsideration. That could put off a decision in the case by months.

David Shaw, a judge for the ITC, had previously ruled in April that the Xbox 360 had infringed on four patents owned by Motorola regarding the use of H.264 video encoding. In May, Judge Shaw recommended that the ITC place a ban on importing the 4 GB and 250 GB versions of the Xbox 360 S consoles into the US as a consequence of the console violating Motorola's patents.

The story gives no reasons while the full ITC board would send the case back to Judge Shaw. The board was previously expected to make a final decision on the Xbox 360 patent case in August. Earlier this month, a number of companies, including Apple, Cisco, HP, Nokia, Intel and Activision, wrote letters to the ITC requesting the organization not ban the Xbox 360 from being imported to the US.

US House of Representatives member Darrell Issa (R-CA) also wrote his own letter to the ITC supporting Microsoft, saying, "An exclusion order would eliminate the only U.S. based videogame console from a market."

You are not very bright. The xbox only comes in 4GB and 250GB so you can't buy a different sized HD. Herp Derp


Apparently, you are not very bright. The Xbox360 Slim now features a 320GB harddrive, my limited edition Mw3 edition has one, and they said they'll be coming out with that size harddrive within a year. So learn some facts about the harddrives for the xbox before you go after someone

The slim comes in only a couple of different hard drive capacities, and there are a few you can buy for the original model. The reason this is happening is because Microsoft voided a Motorola patent about voice communication/video chat through a game system or something. I don't get what you're saying.


I could totally see bribery coming into play, or this being delayed till we see a new Xbox.

That is my name because I made this account a few years ago, and I'm too mature to blow money on this site to be able to change my name and make it pretty and colorful like all the cool kids do. If "you all" never bought their products again, they wouldn't care. They made $3.4 billion last quarter. Lets say, and this is generous, that 100,000 fanboys like you get so mad you don't buy their products, and that you were all going to buy a top-of-the-line $200 smartphone. Motorola MAYBE gets ~$700 for the sale of that phone. That's $70 million gross that they lost. Out of 3.4 billion. You took away 2% of their billions of dollars. They'll make it back in interest in a few months.
Like I said, they don't care about you. Don't fool yourself into thinking they do.
