The developer of calendar app “The Day Before” has confirmed to Eurogamer in a statement that it did indeed initiate proceedings against Fntastic and MyTona’s survival title in order to “protect trademark rights”, what with the game also having adopted the same name as the app itself.
“We first distributed the app under the name ‘The Day Before’ in 2010 to provide anniversary count app services used in many countries around the world,” the app developer said in its statement. “We hold trademark rights to the app’s name ‘The Day Before’ and have so far recorded over 40m downloads.
“Since the trademark registration in Korea in 2015, we have held the right (registered in the name of ‘The Day Before’ CEO Lee Sun-jae). Knowing that the game of the same name was produced, we are taking measures to protect trademark rights.
“We currently hold trademark rights in Korea, the United States, China, Russia, Japan, Vietnam, and the European Union.”
How long it will be before the dispute gets resolved remains to be seen, but Fntastic has previously said that it expects a resolution before the game launches in November (assuming it doesn’t get delayed again, that is).
The Day Before is set to launch on November 10 for PC, PS5, and Xbox Series X/S.
